These Terms and Conditions (“Terms”) govern your use of the website operated by Brian Rogers Marine Engineering (ABN 74 710 480 215) and the purchase of products and services from us. By using the website or placing an order you accept these Terms. If you do not accept them, do not use the website or place an order.
1. Definitions

- “Products”: any goods we supply, including propellers, shafts, bearings, seals, and winches.
- “Services”: any work we perform, including propeller design, repair, machining, and advice.
2. Website Use
You may use the website for personal and legitimate business purposes. You must not:
- Use the website for any unlawful purpose or in a way that could damage or impair it.
- Attempt to gain unauthorised access to the website, its servers, or related systems.

3. Orders & Quotes
Quotes we provide are valid for 30 days unless otherwise stated. Orders are accepted at our discretion. Prices are in Australian Dollars and exclude GST unless stated. We may require a deposit before commencing work.
4. Payment
Payment terms are stated on each quote. For custom work, a 50% deposit is usually required at order and the balance before dispatch. We accept bank transfer and, by arrangement, credit card. Interest at 10% per annum may be charged on overdue invoices.
5. Delivery & Risk
Delivery times are estimates only. Title and risk in the goods pass to you on dispatch from our workshop. We package goods carefully but you are responsible for insuring high-value shipments.

7. Warranty
We warrant that our workmanship is free from defects for 12 months from delivery. Our products carry the manufacturer’s warranty where applicable. Our liability for defective work is limited to repair, replacement, or refund at our discretion.
8. Exclusions & Limitations
Nothing in these Terms excludes any guarantees under the Australian Consumer Law that cannot lawfully be excluded. Otherwise, we exclude liability for consequential loss, loss of profit, loss of use, and third-party claims. Our maximum aggregate liability is limited to the amount paid by you for the goods or services in question.
9. Intellectual Property
All content on the website — including text, images, drawings, designs, and code — is owned by or licensed to us. You may not use any content for commercial purposes without written permission. Designs we produce for you remain our intellectual property unless we specifically assign them in writing.
10. Confidentiality
Both parties agree to keep confidential any non-public information disclosed in the course of business. This obligation survives termination of the agreement.
11. Force Majeure
Neither party is liable for failure to perform due to events beyond its reasonable control, including natural disasters, strikes, pandemics, government action, or supplier failures.
12. Termination
We may terminate your access to the website at any time without notice if we reasonably believe you have breached these Terms. We may cancel orders where a product is no longer available or where a pricing error has occurred.
13. Changes to Terms
We may update these Terms from time to time. Continued use of the website after changes constitutes acceptance.
14. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes are subject to the exclusive jurisdiction of the Queensland courts.
